ND Legislature Threatens to Ban Cow-Share Dairies

We spent the end of our spring break at the North Dakota Legislature testifying in favor of keeping access to raw milk legal.

One day before the hearing, Bartlett Farm received a letter from Dairy Director Wayne Carlson, saying he intended to offer an amendment the next day (3/14/13) to Senate Bill 2072 that will make cow-share dairies illegal in ND. The amendment read, "It is unlawful for any person to own, operate, organize, or otherwise participate in a cow-share program where the milk producing hoofed mammal is located in North Dakota." (view a copy of the letter)

The ND House Agricultural Committee received more emails on this issue than any other they have dealt with this year, thanks to social media and passionate raw milk drinkers in North Dakota.

There were about 9 other testimonies in support of keeping cow-shares and raw milk access legal in North Dakota. There is also some action toward making it legal to buy direct from the farm.
What do you think?  Should the government protect people from themselves?  What is the appropriate biblical response to this amendment? How would you vote or edit the amendment if you were on the ND House Agricultural Committee?

Dr. Bartlett I just need you to clear up one thing for me. Why are they trying to outlaw raw milk? What is their motive. Are they just trying to make America less agricultural by putting dairys out of business. Everyone knows that a local, decentralized economy is the most stable one. So are they trying to make the economy just that much more centralized by getting rid of these dairy farms?

The ND Department of Ag stated in testimony, that if ND raw milk on a small farm sickened someone, then the bulk buyers of ND big dairy milk would not want to buy big dairy milk from ND. Sounds like a weak argument to me. They also stated that raw milk could be unsafe.  The health aspects have been thoroughly refuted for example here: http://www.realmilk.com/wp-content/uploads/2012/1... As a regulatory agency, the main issue was “clarifying” whether cow sharing was really sharing a cow or simply a clever way to sell raw milk and get around state and federal laws. 

I recommended that the ND Ag Committee take our cow share contract to the attorney general to see if it is “ownership”…owners pay vet fees, get the meat after the cow share ends, only get milk when the cow is producing etc.  See if you think this contract shows ownership, many lawyers do… <a href="http://bartlettuniversity.com/bartlettfarm.us/documents/BartlettFarmCowGoatBoardingAgreement-revm.pdf

That argument does seem to be a little weak, doesn't really make sense. The recommendations you and others come up with seem to make much more sense. Also seems like it would work well for about everybody even them, but I don't know much about it our their motives, what they are trying to do. I'm defiantly not the expert in this area haha but I still enjoy reading and learning about things like this, especially with Christian worldview
It does seem rather silly that the basis of their argument was refuted.
Should a government protect its people from themselves? Yes and no. It's one thing to ban drugs that alter your state of mind. But it's quite another to make it illegal to sell a certain type of milk. Especially when their seem to be insufficient proof of raw milk actually being unsafe.
